We set out various areas of property law work which we can undertake. This list is, of course, not exhaustive.
Conveyancing and non-contentious property work
- The buying and selling of both residential and business property;
- The grant and assignment of leases, both residential and commercial;
- Applying to the landlord of leasehold property for relevant licences or consents, including to carry out works and/or to change the use of the property;
- Providing advice about remortgaging a property, including any separate advice to a potential guarantor of the lender; and
- (By our Consultant Solicitor, Julian Cohen) settling instruments of trust, including to families and where a property is being acquired by co-owners.
Property Litigation/Legal Disputes
The work we carry out on a non-exhaustive basis includes the following:
- Co-ownership disputes, in particular where one party wishes the property to be sold against the wishes of the other, or, where the interest in the property has been challenged by way of equitable accounting;
- Disputes in relation to property boundaries;
- Disputes in relation to rights of way, right of light and/or other easements affecting properties;
- Legal issues in relation to shared driveways, private roads or other joint access;
- Claims in relation to nuisance or other unacceptable conduct from adjoining occupiers;
- Claims for damage following on from works carried out to adjoining property;
- Issues in relation to service charges of leases or freehold management arrangements. In particular, we can represent clients challenging service charges or proposed service charges in the First Tier Tribunal;
- Landlord and Tenant issues, including raising or defending possession proceedings, issues in relation to forfeiture of leases, and disrepair/dilapidation claims;
- Applications to extend long residential leases;
- Right to manage. This can be fraught with potential difficulties, including long leaseholders assuming personal liability for the costs of the freeholder;
- Issues in relation to water penetration from an adjoining property- this is a fairly common problem;
- Disputes in relation to restrictive covenants affecting land;
- Issues in relation to houses in multiple occupations
- Issues in relation to licensing or non-licensing of rental property by the local authority, rent repayment applications, etc.; and
- Applications to enforce charging orders for the sale of a property or the defence of such applications.

For litigation matters, we will assist with any claims for cover under legal expense insurance policies – which generally need to be supported by a favourable opinion from Counsel. It may be challenging to secure cover under legal expense insurance policies but, once proceedings have been issued, policyholders have a statutory right of choice of their solicitors to represent them under the policy.
We can also see our clients at our offices in Central London at 32 Bloomsbury Street, near Tottenham Court Road Underground Station, in North London close to Finchley Central Underground Station and at our office in Hatfield – opposite the mainline station Hertfordshire AL9. There are no parking issues at our North London or Hatfield offices.
