Building and Construction Disputes examples of recent cases
We set out below examples of recent cases which we have been involved with: –
- Disputes with a property owner in relation to a list of alleged defects following a major renovation of a residential property – in this dispute, we acted for the builder.
- A commercial property dispute following the termination of the building contract by the property owner – in this case, we acted for the building contractor, and we have referred the dispute to adjudication. This is a very quick process to achieve a legally binding decision in relation to monies owed. The barrister who we are using to assist us with the case (and to prepare the relevant submissions) is very experienced in relation to this process, and indeed, he himself sits as an adjudicator (as well as an arbitrator).
- Disputes, where we act for the property owner where the builder has left a site with the work unfinished, and the work also has not been properly carried out – this, in fact, is a relatively common scenario.
- We have represented residential homeowners in relation to a dispute involving property work next door including where the adjoining owner has not embarked upon the party wall procedure and where there is damage to our client’s property as well as interference with rights of light, etc.
- We also represent contractors who have been excluded from a site and who have been unable to finish the work due to termination of the contract by a residential property owner.

We can arrange a fixed fee initial consultation and, where urgent, if possible, we will see you on the same day. There may be a particular case where an injunction may be required, especially where adjoining works are causing or likely to cause damage to your property or interfere with rights of light, etc. We also try to see you on the same day where you have received a letter before action or indeed actual court proceedings.
