Court Representation – Examples of some cases that we have dealt with
- Defended Possession Proceedings
We regularly represent Landlords that are subject to defended possession proceeding by their residential tenants in particular where landlords are relying on shorthold s21 notices to quit. This area of the law has become very technical and if a statutory requirement is not met this may provide a defence to a possession application under the s21 accelerated procedure. It is fairly common for us to only be instructed after a defence has been filed although we would prefer to be engaged at the beginning of a matter. We always endeavour to find a route for the landlord to secure possession. Our work in representing landlords includes the filing of detailed witness statements and organising for Counsel to attend the possession hearing. - Employment Tribunal Claims
Our consultant barrister Kevin Harris regularly represents our clients in the employment tribunal for both employers and employees. He is very knowledgeable especially in relation to discrimination claims. In relevant matters, we can represent our client under legal expense policies – and indeed there is a statutory right for a policyholder to have a choice of solicitors once proceedings have been issued. Where there is no insurance available for claimants, we will consider a no win no fee arrangement for reasonably strong cases. - Debt Claims
We have represented clients who wish to pursue or defend claims for recovery of debts. - Applications to set aside Judgments
We represent clients who wish to set aside judgments that have been procured without their knowledge. Such applications should be raised promptly. We usually submit such applications without delay on the basis of preliminary witness statements with further witness evidence to follow as and when reasonably possible. If you discover a judgment against you, please arrange an urgent meeting with us so that we can submit this application.
There are many other examples of cases where we have represented our clients in court. We frequently work with external counsel specialising in the relevant area of law.
