Defence of Disciplinary Claims Against Directors
We are experienced in the following:
- Making representations
 - Requesting disclosure of relevant documents
 - Preparing written responses to the Company’s evidence
 - Rights to be accompanied by a trade representative. We can organise this if so required; and
 - Raising grievances in relation to the disciplinary process
 
We are also very experienced in assisting directors with disciplinary investigations. If the matter cannot be resolved amicably and the working relationship restored, then we try to resolve matters through settlement agreements. This will involve an agreed payment, agreed reference and a partial waiver of non-compete covenants. We will also endeavour to agree on any shares to be bought out.
Defence of performance management procedure
We are very experienced at defending directors/sales managers/ senior managers in relation to performance management procedures.
This will normally involve raising grievances and if the matter cannot be resolved amicably endeavouring to resolve the matter via a settlement agreement/lump sum payment and an agreed reference.
Long Term Sickness Absence – Depression or Stress at Work
We have much experience in relation to this scenario, which will normally involve engaging a specialist consultant and trying to resolve matters by settlement agreement (providing for a lump sum payment and for an agreed reference) if possible and especially if it is clear that the company do not wish the director/manager to return to work. Reliance is made in this situation upon the disability discrimination legislation.
Defending Directors/Managers in Relation to Allegations of Dishonesty/Impropriety
Unfortunately, this is reasonably common, and we are experienced in relation to this scenario. Impropriety includes misuse of confidential information and/or allegations of sexual misconduct. Again, without prejudicial negotiations for a settlement agreement is an acceptable way to resolve these scenarios.
